Obama + ACORN = Vote Fraud: Warren County, Ohio Lawsuit Filed

Plaintiffs Jennifer Miller and Kimberly Grant, residents and registered voters in Warren County, Ohio, with the help of the Buckeye Institute’s 1851 Center for Constitutional Law, filed suit today against ACORN and Project Vote in Warren County Common Pleas Court.

Obama’s name comes up at least three times in the complaint (bolds are mine):

(Page 3) 18. Defendant is engaged in massive voter registration drives and political canvassing throughout the state of Ohio and the United States of America; some of this work is performed on behalf of current United States of America presidential candidate Barack Obama.

(Page 3) 19. ACORN’s political wing has endorsed Barack Obama for president, and during the primary season, the Obama camp paid Citizen Service Inc., $832,598 for various political services according to Federal Elections Commission filings. Citizen Services, Inc. and ACORN share the same board of directors.

(Page 9) 69. In Texas, where ACORN’s affiliate, Citizens Services Inc., has provided contract work on behalf of Senator Barack Obama’s presidential campaign, the Houston Chronicle reported on August 17, 2008 that “About 40 percent of the 27,000 registration cards gathered by ACORN from January through July have been rejected or placed in limbo pending the gathering of more information, according to the county” while “about 6,600 were filled out by people already registered, and many others contained insufficient information.”

Will Old Media report the claims raised by plaintiffs?

UPDATE: Plaintiffs are seeking the following (references are to the Ohio Revised Code):
(1) The dissolution of Defendant ACORN, pursuant to R.C. 2923.34(C)(3).
(2) The revocation of any license or permit that allows Defendant ACORN to carry on its business in the State of Ohio, pursuant to R.C. 2923.34(C)(4).
(3) The imposition of restrictions upon Defendant ACORN’s future political and elections-related activities, including restrictions that prohibit the Defendants from engaging in the same type of activity that has produced the pattern of corrupt activity articulated in this Complaint, pursuant to R.C. 2923.34(C)(2).
(4) The imposition of a restriction prohibiting ACORN from circumventing such a court order through the use of third-party operations or sham organizations.
(5) The awarding of attorneys fees to Plaintiffs, pursuant to R.C. 2923.34(G).
(6) The awarding such other and further relief as the court shall deem just and equitable.

UPDATE 2: I’d ordinarily be inclined to see the humor in the Mickey Mouse voter registration noted here. But this is about whether a congenitally corrupt organization will be allowed to desecrate the secular temple known as the voting booth. So, excuse me, I’m not laughing.

UPDATE 3: This is wayyyyyyyy too late to matter, and totally ineffectual, for the reasons noted —

The Obama campaign is now distancing itself from Acorn, claiming Mr. Obama never organized with it and has nothing to do with illegal voter registration. Yet it’s disingenuous to channel cash into an operation with a history of fraud and then claim you’re shocked to discover reports of fraud. As with Rev. Jeremiah Wright and William Ayers, Mr. Obama was happy to associate with Acorn when it suited his purposes. But now that he’s on the brink of the Presidency, he wants to disavow his ties.

The Justice Department needs to treat these fraud reports as something larger than a few local violators. The question is whether Acorn is systematically subverting U.S. election law — on the taxpayer’s dime.

  1. I doubt the suit will succeed in dissolving ACORN or revoking its licenses. To do that, the Ohio AG has to jump in … and she won’t.

  2. I hope this can be adjudicated in open court before election day. ACORN has to submit all forms in most states and flags bogus or problematic ones. Nine US attorneys were fired by the Bush White House in 2006 for not prosecuting bogus voter fraud allegations. There is virtually no voter impersonation going on in this country but you are welcome to try and register as Mickey Mouse and put on a costume and try.

    Let’s face it, ACORN registered a million new voters this year. Less than 3% of those registrations turned out to be phony, incomplete, duplicates or otherwise problematic. In any case none of those 3% will be allowed to vote unless they are properly registered. In most cases the flaws in the registration were pointed out by ACORN itself to election authorities.

    Once more another Republican voter disenfranchisement plan will go down the crapper. I can’t wait, let’s get it all out in the open and let the American people see what this is really all about.

  9. Careful people, don’t focus too much on ACORN because the libs are very tricky in supplying a faux issue for Repubs to chew upon while they successfully advance in another area. I would like to point out that while what ACORN is doing is wrong, not simply because they are trying to subvert the voter registration process, but in actuality OVERWHELM it. It should be obvious to any poll worker or election offical looking at individual registrations that “Mickey Mouse” is a fraudulent registration and no one is going to physically show up on election day claiming they are Mickey Mouse. One would hope that in this day and age of computer data bases, they would flag common fictious names and then purge them from the data base after confirming it is fraudulent. This still takes a lot of time since you have to verify each and every suspected flagged name.

    If Mickey Mouse sends in an absentee ballot, that is counted via a machine instead of a person, that fraudulent vote might possibly be counted. I

    Now here is where the tricky part comes in, by keeping the elections officials so busy with ACORN and Mickey Mouse, all the people who moved out or died within 2 years of the election whose names have not been purged from the voter rolls could still potentially be used to cast votes. That is a significant number given the mobility of the population. This is how the Democrat Party Machine in Philadelphia and Chicago pull this off. This is why they have more registered voters than there are people of voting age. It would be a triumph of Democracy if every person of voting age registered to vote, let alone voted. The feds have forced the purging of the voter registration rolls every two years. If you will remember the Milwaukee pols screamed when they were forced to purge the voter rolls and virtually a third of the names dropped off the list.

    Here in Florida, I won’t speak for other states, the election’s commission sends out sample ballots to every registered voter before election day, IF any of those sample ballots come back due to address change, that name is purged from the voter rolls and thus prevents someone from stuffing the ballot box with fraudulent votes. Of course as an added measure we must show ID or be flagged with a provisional ballot. The weakness of the system though is if you have a corrupt person in the elections commission capturing those returned ballots via the post office and then casting a vote in their place via an absentee ballot. One could also just have a person vote repeatedly using what they know to be a person’s name who no longer resides in the area. The Dems call that walking money.

  11. #8, total, red, herring. BOE reps, equal Dem and GOP, observed the counting. Outsiders didn’t. Maybe discourteous, but TOTALLY unrelated to vote fraud.

    #9 and #10, believe me, I understand your point, and am intensely PO’d about it. Sowing confusion and discord is a fundamental radical Alinskyesque strategy.

    This is why registrations have to end at least 30, if not 60, days before elections, and why ANYONE who fills out a false registration form needs to spend a bit of time behind bars, have a criminal record, and pay a heavy fine to reimburse for the excessive work. Also, NO ONE besides the person registering should be allowed to turn in the registration form, and to an actual BOE member.

  15. #14, if you think I’m going to include links to Truthout (how’s that Rove indictment going?) and Palast (still thinks FL was stolen), and RFK Jr. (still thinks OH 2004 was stolen because the real votes didn’t agree with the almighty exit polls), you’re sadly mistaken.

    As to the first actual link remaining — Here’s the howler, “Here are the facts. Acorn verifies the legitimacy of every registration its canvassers collect.” I can’t type enough ha-ha’s to adequately document how hilarious that is.

    As to the TBO link, the reason for the higher DQ rate is that Dems are more likely to attempt to register erroneously or fraudulently.

    We can I suppose debate the nature of GOP/conservative brains, but at least we have brains to debate the nature of.

  16. I really hope this curtails the unlawful activities of ACORN. I’m in Pennsylvania. I received dozens of calls from ACORN trying to get me to go to Ohio to register and submit absentee ballots. After I told them to stop calling and I am registered to vote in Pennsylvania, ACORN doubled its efforts to enlist me in their registration and voter fraud. This organization is not a legitimate registration organization.

  18. Questioning the American Bolshevik views
    1. Is wealth redistribution taking money from stockholders and redistributing it to those who don’t pay taxes?
    2. Is it more important to make sure that illegal votes are not disenfranchised or making sure that groups like ACORN do not nullify honest votes.
    3. Would premature U.S. withdrawal from Iraq grand jihadists a victory and make all of our accomplishments, money spent and lives lost a big waist?
    4. Can this country afford to grant socialist Democrats total control of the government and allow them to sacrifice our safety by cutting the military budget by 25%?
    Now comes the big question. How do we stop socialism from ruining our lives?
    The answer is simple. Don’t vote American Bolsheviks into power and boycott the socialist propaganda media into bankruptcy.
